Generic Short Course Booking
Variation Prices are correct at time of printing, but may be subject to variation, in which case we reserve the right to charge the fee applying at the time we receive this booking form. The British Safety Council (hereinafter 'BSC') reserves the right to vary the course content from that advertised in the BSC's promotional materials without liability.
Payment Terms Payment is due 30 days from invoice date. In certain circumstances, a non-refundable deposit may be required. Where the service delivery date is within 30 days of booking, payment is due upon booking. The BSC reserves the right to withhold service delivery where cleared funds are not received prior to the service commencement date.
Transfer Charges Notification is required in all instances and must be in writing. Where notice is received 28 days or more prior to service commencement a 10% transfer fee applies. Where notification is received between 27 and 14 days prior to course commencement a 25% transfer fee applies. Where notice is received fewer than 14 days prior to course commencement full fees are payable.
Cancellations All cancellations incur a 30% cancellation fee (VAT excluded) and must be in writing. Full fees are payable where notice is given fewer than 14 days prior to course commencement or in the event of non-attendance. We reserve the right to cancel any course at any time without liability. In these circumstances we will offer at our discretion alternative options, a credit note or a refund of fees paid.

By signing the form the signatory confirms they are accepting the above Terms and Conditions and confirming that the Candidate complies with the entry requirements for the qualification/course as detailed in the promotional literature. Copies of these can be found at www.britsafe.org/Qualifications. The British Safety Council reserves the right to request evidence of compliance with the entry requirements.
Free Membership Offer Non member organisations booking either a British Safety Council Level 3 CertOSH or a NEBOSH NGC qualification after 18 August 2008 with the BSC are entitled to a free subscription to British Safety Council Membership for a period of 12 calendar months. This is for a nominated site only and standard terms and conditions for BSC membership apply, including the use of the Members’ Logo. These can be found at http://www.britishsafetycouncil.co.uk/policy/BSC-terms-and-conditions.aspx. Additional sites can be added at the published rate. The organisation is entitled to one free subscription at the site where the Candidate is based. The free membership is not transferable to another site or in relation to any candidate other than the one on the original booking. At the end of this period, the organisation has the option to renew their membership at the prevailing published rate at time of renewal.
If the qualification booking is cancelled at any time, free membership will also be terminated. The organisation will however have the option of becoming a member at the published membership rate at time of membership application.
BSC reserves the right to refuse or terminate membership at any stage where the organisation brings the BSC into disrepute or fails to make timely payments for any services. This offer is not available to existing subscribing members and cannot be applied retrospectively for organisations who purchased the BSC Level 3 CertOSH qualification prior to 18 August 2008.
This offer can be cancelled at any time by the BSC at its discretion without prejudice to potential candidates / members.
Free Level 3 Exam Re-sit The one free exam re-sit offer applies only to individual Candidates and to written examinations for the NEBOSH NGC1 and NGC2 and BSC Level 3 CertOSH. Only one free re-sit is available for any chosen examination and must be taken within 12 months of the results notification. Free re-sits are not transferable from NEBOSH NGC1 to NGC2 or the BSC Level 3 CertOSH examinations or to another Candidate. This offer is subject to availability of places at any given examination sitting of the Candidate's preference.
NEBOSH Qualification Course Bookings

Student Terms and Conditions including malpractice policy are contained in the Study Pack and apply upon registration. The BSC reserve the right to terminate this booking where the student is found not suitable for the course due to academic abilities determined through the Student Registration process. Full fees minus a £100 administration charge will be refunded where this happens. BSC also reserve the right to refuse any student (continued) entry to the course where there is any inappropriate behaviour towards the Tutor or fellow students. The organisation paying the course fee will be notified in writing stating reasons. No fees will be reimbursed except at the discretion of the BSC. Student access to on-line services is for a period of 12 months with option to renew. BSC reserves the right to to change suppliers or provide alternate sources of information without notice. Each student is entitled to one free re-sit of GC1E and GC2E where the student has failed the examination at first attempt. This is not available where student wishes to obtain a higher grade or missed an examination. NVQ

Transfer Charges Where written notification of a transfer of dates is given to the British Safety Council more than 14 days prior to the designated NVQ Portfolio Day, a £200 charge will be incurred. Where fewer than 14 days' notification is given, fees of £350 plus VAT are payable.
Cancellation Charges Where written notification of a transfer of dates is given to the British Safety Council more than 14 days prior to the designated NVQ Portfolio Day, a £200 charge will be incurred. Candidates will be supported by the BSC for two years from the Portfolio Day date. If after two years candidates have still not achieved their NVQ, they will be automatically removed from the British Safety Council database and NVQ contract will come to an end with no refund or credit due.
City & Guilds registration is non-transferable. No refund can be made to candidate or organisation if either changes

The British Safety Council (hereinafter 'BSC') reserves the right to reasonably vary the service from that advertised in the BSC's promotional materials without liability.
Payment Terms Payment is due 30 days before delivery of service. In certain circumstances, a non-refundable deposit may be required. Where the service delivery date is within 30 days of booking, payment is due upon booking. The BSC reserves the right to withhold service delivery where cleared funds are not received prior to the service commencement date.
Transfer Charges Written notification is required and incurs a 10% transfer fee. Where written notification is given fewer than 14 days prior to service commencement, 50% fees are payable.
Cancellations incur a 30% administration fee (VAT exempt) and must be in writing. Full fees are payable where notice is given fewer than 14 days prior to service delivery. We reserve the right to cancel the service at any time without liability. In these circumstances we will offer at our discretion alternative options, a credit note or a refund of fees paid.
Limitation of Liability To the extent permissible by law, the BSC (or its servants, agents, contractors or suppliers) shall not be liable to any person acting or omitting to act in reliance on any material or representation provided or presented to that person for any losses, whether direct or consequential, whether or not caused by or resulting from any negligent act, error or omission or breach of contract or otherwise of the BSC (or its servants, agents, contractors or suppliers), except to the extent that any such loss does not exceed 10 times the price of the service. For the avoidance of doubt, such losses include and are not limited to any loss of business, loss of profits, loss of contract, damage to reputation or goodwill, damage to property or financial loss, any damages, costs, expenses incurred or payable to any third party and all indirect losses.
Data Protection All personal data collected will be used for the purposes of taking payment, administering and delivering BSC Services within the requirements of the Data Protection Act. We would like to keep you informed of other BSC products, services and news items that we feel may be of value and interest to you. Please write to the British Safety Council if you do not wish to be kept informed or receive marketing materials. We may also pass your details to other selected partners and clients, please tick this box if you do not wish us to do so.
Audit Delivery and Report The Audit is conducted by reviewing the Organisation's health and safety documentation and systems; followed by an inspection of the sites and associated buildings. The inspection is a tool used to determine the effectiveness of the implementation of the Organisation's health and safety standards. The report identifies the strengths and areas for improvement in the Organisation's health and safety management systems and provides recommendations for consideration. The audit seeks to ensure all aspects of health and safety have been covered by the management systems and assesses the efficiency of the system. The audit is not a safety check. The audit report will only comment on the conditions observed and the impressions gained during the visit.
Every effort will be made to ensure that all statements and information offered in the report are given in good faith, they relate to matters seen during the audit and information supplied by the Organisation. The Auditor assumes that the information supplied and representations made by the Organisation during the audit on which the report is based is up to date, accurate and complete. The Organisation must notify the BSC of any factual inaccuracies in the report or misinterpretation of information provided by the organisation as reflected in the report.
The items commented on in the report are limited to areas identified at the time of the audit, and should not be taken as identifying all areas of possible unsafe conditions and/or contravention of statutory requirements. Due to the nature of ongoing activity, the report may cease to be entirely accurate immediately after being provided to the Organisation.
All relevant information contained in this report should be disclosed to the Organisation's insurers, the contents of the report alone may not be suitable and further information may be required by insurers. BSC accept no responsibility to the Organisation or their (potential) insurers as a result of inaccuracies in the report arising for whatever reason if the report is disclosed for the purposes of obtaining insurance.
Sites must be operational for the purposes of auditing, BSC retain the right to postpone an audit (at the client's expense) where the site is not operational by the date of scheduled audit.
OHSAS 18001 Audits
The BSC reserve the right to revoke an OHSAS 18001 registration if the required number of surveillance visits are not carried out.

Governing Law This Agreement shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the jurisdiction of the English Courts as regards any claim or matter arising in relation to this Agreement.

Transfer Charges Transfer of dates within the same calendar month as the original date(s) WITH more than 6 months' written notice will be free of charge. Where less than 6 months' written notification is given 10% of the daily fee is payable. Where less than 14 days' written notice is given the full daily fees are payable. All transfers must be within the same calendar month as the original dates. Failure to do so may put your certification at risk.
Cancellation Cancellations incur a 50% administration fee except where written notice is given fewer than 14 days before the start of the service, in which cases full fees are payable. We reserve the right to cancel the service at any time without liability. In these circumstances we will offer alternative dates, a credit note or a refund of fees paid.

Learning Zone Booking

The British Safety Council (hereinafter 'BSC') reserves the right to vary event arrangements where necessary without liability.
Payment Terms Payment is due 30 days from invoice date. In certain circumstances, a non-refundable deposit may be required. Where the service delivery date is within 30 days of booking, payment is due upon booking. The BSC reserves the right to withhold service delivery where cleared funds are not received prior to the service commencement date.
Transfer Charges Notification is required in all instances and must be in writing. Where notice is received 28 days or more prior to service commencement a 10% transfer fee applies. Where notification is received between 27 and 14 days prior to course commencement a 25% transfer fee applies. Where notice is received fewer than 14 days prior to course commencement full fees are payable.
Cancellations All cancellations incur a 30% cancellation fee (VAT excluded) and must be in writing. Full fees are payable where notice is given fewer than 14 days prior to event commencement. Event Details The contract is based on the Client's requirements at the time of signing this contract as outlined in the Event Details Sheet which forms part of this contract. Any request by the Client wishing to change or add to any aspect of the Event must be received in writing at least 3 working days before the event start date; the BSC will confirm in writing by return if BSC can meet with changed request and advise on any additional costs. No refund or reduction in fees will be made if less than the stated number of delegates attend on the day. Any additional delegates from the number stated will be invoiced separately at the above rate per delegate. The BSC reserve the right to refuse additional delegates unless otherwise agreed in writing at least three days prior to the event. BSC reserve the right to cancel the booking if the event may prejudice the reputation of the BSC. The Client and persons acting on their behalf and attending the event shall not act in a disorderly manner, make any alterations to the rooms or equipment, and shall arrive and leave promptly at the times detailed in the event sheet and meet with reasonable requests from BSC staff. All BSC health, safety and environmental procedures must be adhered to at all times. The Client will be responsible for the full cost of damage made to any fixtures, fittings or equipment by their staff, delegates or other event attendees. The Client may not bring their own catering or beverages onto the premises without the prior written consent of BSC. BSC are not responsible for or liable for the damage, loss or theft of any property brought onto the premises or delivered to the premises for the purposes of the Event or otherwise. Any additional delegates from the number stated will be invoiced separately at the above rate per delegate) The Client shall at all times be liable for, indemnify and hold harmless the BSC (together with its employees, servants and agents) from and against any and all claims, liability, loss, damages, fines, costs, legal costs, professional and other expenses of any nature whatsoever incurred or suffered by the BSC arising out of or in connection with: a) any property damage suffered by the BSC in the Event space used by the Client; b) the acts or omissions of (i) the Client (including its agents and/or sub-contractors); (ii) the Guests, including without limitation any statement or conduct that (in the BSC?s absolute discretion) is defamatory, racist, likely to cause or stir any threatening behaviour or may bring the BSC name into disrepute. This Event Agreement shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts. The BSC grants a licence to the Client to use the BSC premises strictly for the purpose of the Event as stated in the Event Agreement. The event space allocated is dependent on guest numbers. The BSC reserves the right to change the Client's assigned event space, in its sole discretion, a reasonable operational reason for doing so. We will endeavour to give prior notice. The Event shall start and finish at the time set out in the Event Agreement, failing which the Client shall be liable for additional charges. The Client shall pay the BSC for any food, beverages and other services not provided for in the Event Agreement but made available on request of the Client during the Event. Any special dietary requirements must be stated on the event sheet or BSC must be notified at least 3 working days prior to the Event. The BSC will endeavour to meet with special dietary requirements but cannot guarantee to do so. There is no parking available on BSC premises at any time. The BSC operates in compliance with the Disability Discrimination Act.
